Consider the following information regarding the background and credibility of the accusers... Something the media did not report on and the public has the right to know. You may ask, why the media is not reporting these FACTS? Simple, it doesn’t sell…. A criminal being a criminal does not sell, but on the other hand, a decorated officer turned rogue makes for a great headline.
Accusers with a track record of criminal activity, lying under oath and mental health issues cannot be considered credible without supporting evidence, yet the government used their testimony anyway to obtain the grand jury indictment.
Why has the media never reported any of these facts in regards to the accusers when it is all public records. Again, simply put, a criminal just being a criminal is not newsworthy and sensational.
The government turned a blind eye to human trafficking and other illicit criminal activity in exchange for the false testimony to discredit a law enforcement officer.
Jessie Menocal, Jr. was never asked nor afforded the opportunity to present his side of the case in regards to the allegations.
Why would the government seek a grand jury indictment, but never even ask for his account or his side of the story. He was never talked to or questioned, instead he was placed on a gag order and not allowed to clear his name or talk to the press or the public about his case – the one time his attorney made a comment to the press in regards to the credibility of one of the accusers, they were immediately brought into court, admonished and instructed that no further comments in regards to the case could be made otherwise it would jeopardize terms of pre-trial release -- A very frustrating situation to say the least for both Mr. Menocal and his family.
Facts To Take Into Consideration: Why was a person who was not part of the plea agreement, essentially not a “victim”, nor part of the case, allowed to speak in court as a “victim” and then present herself to the media at a press conference claiming to be a “victim” all while having a civil lawsuit open with the city. Clearly, this was driven by money and greed at the expense of Mr. Menocal and his family.
At the sentencing hearing, only 2 out of the 3 accusers appeared in court. The other person who was allowed to speak to the judge was an accuser that the government felt they had insufficient evidence and dropped the charges.
The one accuser that did not show up to court, gave a documented statement prior to Mr. Menocal’s indictment that she did not want to proceed with the case and would not be attending court; The government indicted him regardless. In any other proceeding, if there is no victim, there is no crime.
Another accuser was interviewed by investigators while confined at a mental health facility while being treated for mental health crisis and has a long history of mental health illness, drug abuse and prostitution. How credible is this statement? No statement would be considered credible in court if taken from someone who was in a mental health crisis. It appears to be the government knew they had a weak case and was grasping at straws.
Note this misdemeanor charge was brought forward months after the initial indictment.
Another accuser was arrested for domestic battery on her boyfriend, who also was a law enforcement officer for the same agency as Mr. Menocal, and she was allowed to file a departmental complaint once Mr. Menocal was no longer employed with the city which is not common practice. Once an officer is no longer employed with an agency they no longer conduct an internal investigation as the officer is no longer an employee. One could assume, she conveniently made up her allegation and had her domestic battery charges dropped in return for her testimony. Of note, is that her allegations allegedly occurred outside the statute of limitations, not allowing charges to be brought forth, but Mr. Menocal had to agree to allow the government to charge him with her false accusation in order to take the misdemeanor plea and put this in the past. Any reasonable person would ask, why didn’t she come forward prior? This accuser showed her mental instability while at the sentencing hearing making threats in her statement including hoping that Mr. Menocal would get into a vehicle accident and kill someone, that his house would burn down with his family in it, that he would get cancer and die and other absurdities. Her speech was inconsistent and contradictory to say the least.
This should give you more clarity and insight into the untold truth of this case. It is unfortunate that the media and journalism as a whole, have chosen to participate in selective, biased reporting and to focus on a false narrative, for increased ratings, views, and sales. For the average citizen, it is almost impossible to identify fake news and false narrative because we are socially conditioned to believe if the media says or writes it, it must be true. It is further unthinkable that nowadays, we are unable to trust the media to relay accurate information. Fake news does indeed exist… as we said, all supporting documents are public record. We understand it is easier to be spoon-fed false rhetoric and anti-police sentiment which is very popular these days, but the truth is still the truth!
